1) Legally Binding Agreement:
By signing a contract with Diamond Exterior Cleaning, you are signing a legally binding contract for work to be completed at an agreed-upon price. In the event that you break this contract, all deposits made to the company shall be surrendered as damages. These terms and conditions shall be deemed to be incorporated into all contracts between; Diamond Exterior Cleaning and address appears overleaf/attached ("the Supplier") and the person, persons or company whose name appears overleaf/attached ("the Customer") for the supply by the Supplier of goods and/or services specified overleaf/attached. In the absence of express written agreement to the contrary such goods and/or services are tendered or delivered and work undertaken upon and subject to these terms and conditions only.
2) Product Warranties:
All warranties are limited to those offered by the manufacturers of the products used. Diamond Exterior Cleaning offer no additional warranties. If you ever have a concern regarding our work. Diamond Exterior Cleaning should be notified within 3 working days.
3) Water Usage:
By signing this agreement, you agree to provide Diamond Exterior Cleaning the right to use an on-site water supply as needed to complete the stated project without compensation. If an exterior water supply is required, it will be at an additional charge. It is the customer’s responsibility to make sure the water supply is on and in working order before we arrive. Additional charges will be applied if water is not available.
4) Electrical Usage:
By signing this agreement, you agree to provide Diamond Exterior Cleaning the right to use an on-site source of electricity as needed to complete the stated project without compensation. If an exterior source is required, it will be at an additional charge.
5) Color and Tone Concerns:
Render, Stone, Brick, Blockpavers & Wood age and weathering can greatly affect the resulting colour or tone of the surface after cleaning. Note: Variances may occur on individual surfaces as well as the total project, as densities and other characteristics vary across and throughout the surface. Diamond Exterior Cleaning and its associates attempt to represent the final finish colour and tones as best as possible. While we can often give you an idea of the overall colour or tone you must expect some variance in the overall finish.
6) Courtesy:
While Diamond Exterior Cleaning is on location and performing work on your property, you are responsible for keeping all children and pets, as well as other individuals away from the work area. Children and pets must be kept off the work surface for at least 24 hours after our work is completed. This is for your safety as well as our own, Diamond Exterior Cleaning where possible will use eco friendly pet & child safe products. It is advised that all windows & doors remain shut during the duration of works.
7) Payments:
Payments to Diamond Exterior Cleaning are due as per the contract schedule and are to be paid by Bank Transfer within 7 days(commercial works) Programmed maintenance will have set intervals of payments. All balances are ALWAYS due upon completion of the job for residential works. Any variance to this policy must be agreed upon and in writing on our contract. Late charges will be immediately assessed on all balances not paid in accordance with contract terms. The customer agrees to pay any collection cost incurred by Diamond Exterior Cleaning related to the collection process of outstanding balances.
8) Scheduling:
Scheduling in a business which productivity relies upon the weather can be difficult. Inclement weather may affect scheduling. We try our best to keep scheduling conflicts to a minimum, however, circumstances that are beyond our control may affect your project start and completion dates. You will be notified of any changes.
9) Removal & Replacement of contents:
Removal and replacement plant pots, garden furniture, vehicles, ornaments and any other items are the responsibility of the homeowner. Should we need to remove items from the work area, we will not be responsible for any damage, breakage or for storage issues. An additional charge may be applied for the time and labour devoted to the removal of these items.
10) Damages:
Diamond Exterior Cleaning is not responsible for damages due to improperly installed weather proofing, loose roof tiles, broken or opened windows, improperly sealed windows and doors, wood rot, defective construction, improperly secured wires, loose or improperly installed gutters, and leaders and improper caulking. In every aluminum siding case and in some cases with vinyl siding, the sun and weather will bleach the colour or cause fading. Power washing, which entails the removal of chalky, gritty, or failing surface materials may cause the faded aspects of the vinyl or aluminum to stand out. Diamond Exterior Cleaning will not be responsible for such conditions. Diamond Exterior Cleaning will not be responsible for loose mortar that may dislodge during the cleaning process, Diamond Exterior Cleaning can not be held responsible for loose or flaking paint that may fail during the cleaning process.
11) Stains:
Some stains cannot be removed by power washing. Tree sap, artillery fungus, splatters from stains and paints are examples of materials that cannot be removed by conventional means. We make every attempt to point these areas out to the customer when quoting the project. Sometimes these stains cannot be removed at all.
12) Watertight:
Diamond Exterior Cleaning expects your property to be in good repair and weathertight. This includes but is not limited to all electrical services including receptacles and light fixtures. Doors and windows shall also be weathertight. Diamond Exterior Cleaning is not responsible for damages because of water infiltration from poor or improper installation, maintenance, or repair of electrical-related items or doors or windows.
13) Window Spotting:
Windows may become water spotted as a result of our services. Window cleaning is NOT included unless specified and quoted for. Old pvc may not appear bright white, window cleaning alone will not rectify this, and Diamond Exterior Cleaning can not be held responsible for uv damage and colour bleaching.
14) Concrete:
The appearance of concrete depends on a number of factors most linked to when the concrete was initially poured and cured. When concrete with dirt, mold, mildew, algae and other pollutants and stains is cleaned, the concrete will then reveal any and all imperfections that the pollutants and stains have covered up. The customer understands that not all concrete will look the same even on the same driveway, patio, sidewalk, or concrete slab.
15) Drainage:
Diamond Exterior Cleaning can not be held responsible for poor drainage, we will make every effort to ensure all water drains down drainage systems. We will leave all drainage system clear upon completion of works. Diamond Exterior Cleaning can not be held responsible for blocked drainage caused by poor drainage.
16) Parking:
Diamond Exterior Cleaning use van mounted cleaning systems, parking is required on the property or within 10m of the property. Diamond Exterior Cleaning reserves the right to cancel planned works due to limited parking, where residents’ permits are required, this is to be supplied to Diamond Exterior Cleaning, where double yellows or parking restrictions occur. Diamond Exterior Cleaning will apply for parking dispensations added to the total cost of the bill.
17) High Level Access:
Diamond Exterior Cleaning try to complete all external cleaning tasks from ground level with extendable poles. Where access equipment is required (scaffold structures) this will be down to the customer to provide. Diamond Exterior Cleaning can provide at an additional cost. Tower scaffolds and powered access will be provided by Diamond Exterior Cleaning when the need arises.
18) Product effectiveness:
Diamond Exterior Cleaning use state of the art biocides, oxidisers & stain removers. The majority of Diamond Exterior Cleaning products do not show instant results, biocides work over weeks and months to remove organic biofilms and will continuously self-clean with the aid of uv rays and rainfall. Diamond Exterior Cleaning should be paid upon completion of application and not on completion of results. Test samples are available at the cost of £30 to determine time scales and results, this is refundable upon acceptance of a quotation.
19) Damages
The Supplier agrees to perform the work specified overleaf/attached in a competant
manner using reasonable care to attain the best possible results. However, all liability shall be excluded in respect of loss or damage arising from:
(i) Faulty manufacture or inherent defect in any material ("material") which is the subject of this contract
(ii) Misuse, damage or cleaning of any, material by the customer prior to work being undertaken
(iii) Poor colour fastness or dimensional instability of any material which is apparent upon testing by the Supplier prior to work being undertaken
(iv) Manufacturer's or other dye or markings on any material which is not apparent upon testing by the Supplier prior to work being undertaken
(v) Failure to remove all stains, soiling & lichens
